FTX and Bybit reach a settlement

The bankruptcy estate administrator of FTX has reached a settlement agreement of $228 million with Bybit exchange. According to legal documents dated October 24th, this settlement stems from a lawsuit filed by the FTX estate administrator in 2023, aimed at recovering funds to repay past customers and creditors.

According to legal documents, the settlement agreement will allow FTX to extract $175 million in digital assets held on Bybit and sell approximately $53 million in BIT tokens to Mirana Corp, the investment arm of Bybit exchange. FTX's lawyer pointed out that although the claim has legal basis, continuing the litigation will be very cumbersome:

The plaintiff's claims regarding return, violation of automatic protection orders, fraud, and priority transfer are disputed and carry certain risks, and continuing the litigation will be time-consuming and expensive

The settlement agreement still requires court approval, and both parties are scheduled to hold a hearing on November 20, 2024 at 2 pm Eastern Time to confirm the agreement.

FTX bankruptcy estate administrator sues Bybit

FTX initially filed a $1 billion lawsuit against Bybit and Mirana in November 2023, accusing these entities of using "VIP" channels and close relationships with FTX executives to quickly extract approximately $327 million in digital assets and cash before FTX ultimately collapsed.

The lawyer for the bankruptcy estate administrator of FTX pointed out that Mirana and other personnel were granted priority withdrawal privileges by the FTX team during the early stages of FTX's collapse, and these withdrawal records were tracked in a database.

When will FTX repay?

FTX's repayment plan was approved earlier this month, designating at least $12.6 billion for distribution to creditors. The payment will begin within 60 days after the effective date, but the date is still to be determined.
